History : US Customs in February of 2023 Published a Federal Register Notice expanding the Pilot known as Sec 321 https://www.federalregister.gov/documents/2023/02/16/2023-03279/section-321-data-pilot-modification-of-data-elements-expansion-of-pilot-to-include-additional-test The Sec 321 Pilot as it has come to be known , established in August of 2019 initially included 8 members As the data service provider for several of these participants , We at AIMS have years of experience working with this Pilot and have seen first hand the benefits of participation. With eCommerce imports now at nearly 1 billion entries per year under both the Sec 321 and Entry Type 86 Pilots , it is understandable that US Customs has looked to the trade to help streamline and sort those facilitators of eCommerce imports into a more robust , trusted set of participants. In terms of data accuracy and enhancements this then allows for USCBP to better target violative shipments , while allowing for those shipments that are deemed less concerning , to move cross border more efficiently. This is what the Sec 321 Data Pilot is at heart. Participation is voluntary , as USCBP encourages trade members to provide an enhanced manifest data set , which allows for use of modern technology in targeting imports of DeMinimis shipments under the current regulations.

Benefit : The Pilot as currently configured is a voluntary submission of data against an import arrival , in multiple modes of transportation , the benefits are mostly forward facing We have seen a much lower targeting or exam rates with the participants we have worked with for the past 4 years under this program . In addition USCBP has in most cases prioritized holds or exams for these participants, in exchange for supplying data sets that include for example URL links to products marketed on line The expansion of the pilot , indicates that the intention of US Customs is to identify those entities that can be considered " lower risk" in the sense that data is being made available to help determine admissibility into the commerce of the USA .
